- You rent whole physical servers that we own. You get root access and are responsible for what runs on them.

About these terms
#These Terms of Service ("Terms") govern your use of AIXS_CLOUD dedicated servers, related services and the client area at my.aixscloud.com (together, the "Services"). AIXS_CLOUD is a product of AIXS Technology ("we", "us"). The legal entity that contracts with you will be named here before launch.
By creating an account or placing an order you accept these Terms together with the Acceptable Use Policy, the Privacy Policy, the Service Level Agreement and the Refund Policy, which form part of them.
The service
#We provide unmanaged dedicated servers: physical machines we own, installed in third-party colocation facilities and connected to our network. Each server comes with the hardware, port speed, traffic allowance, IP addresses and included DDoS protection listed for its plan when you order.
Unmanaged means we keep the hardware, power and network running, and you administer the operating system and everything on it. Remote hands, reinstalls and hardware diagnosis are available by ticket in the client area.
Included DDoS protection works as described on the DDoS protection page, including what happens when an attack exceeds the included capacity.
Accounts
#- You must be at least 18 and able to enter a binding contract, for yourself or for the organisation you represent.
- Keep your account details accurate and your credentials safe. You are responsible for everything done through your account.
- Identity checks: No ID check by default. We may ask for verification if an order is flagged by fraud screening.
- You may resell services you run on your servers. You remain responsible for how your customers use them under these Terms and the AUP.
Orders and delivery
#An order is accepted when its first invoice is paid. Our delivery targets are 2 hours from payment for in-stock servers and 24–72 hours for built-to-order servers.
Prices and stock shown on the website come from our billing system and can change until you pay; the invoice is what you pay. If we cannot deliver an order, we tell you and you can cancel it under the Refund Policy.
Payment and renewal
#- Prices and invoices are in USD. Accepted payment methods: Credit / debit card, PayPal, Crypto (USDT, BTC, ETH and more), and Bank transfer (USD).
- Prices exclude taxes unless an invoice says otherwise. You pay any taxes that apply to you.
- Services renew automatically for the same billing cycle. The renewal invoice is issued in the client area before the due date.
- To stop a renewal, request cancellation in the client area before the due date. Cancellation takes effect at the end of the paid period unless you ask for it to be immediate.
- A price change for an existing service applies from its next renewal and is announced before that invoice is issued.
Your responsibilities
#- Secure your server: keep software updated, use strong credentials and close what you do not need.
- Keep your own backups. We do not back up servers, and a failed disk, a reinstall or termination can erase data permanently.
- Follow the AUP and the law that applies to you and to the location of your server.
- Answer abuse notices about your server within the deadline stated in the notice.
Suspension
#We may suspend a service, with notice where practical, if:
- an invoice is overdue;
- the service breaks the AUP or the law, or receives abuse reports that you do not resolve;
- an address on it is under an attack larger than the included protection, in which case that address is null-routed for 30 minutes;
- the service puts our network, other customers or third parties at risk.
We restore a suspended service once the cause is resolved, unless it has been terminated.
Cancellation and termination
#- You can cancel any service from the client area.
- We can terminate a service for serious or repeated AUP breaches, for invoices still unpaid after suspension, or with reasonable notice if we stop offering it.
- When a service ends, the server is wiped and reassigned. Its data cannot be recovered, so copy what you need before the end date.
Availability and credits
#Network availability and service credits are set out in the Service Level Agreement. Service credits are your remedy for downtime it covers.
Liability
#We provide the Services with reasonable skill and care. Beyond that, and as far as the law allows, they are provided "as is".
Neither side is liable for indirect or consequential loss, such as lost profit, revenue or data. Our total liability for any claim is limited to the fees you paid for the affected service in the three months before the claim.
Nothing in these Terms limits liability that cannot be limited by law.
Governing law
#To be confirmedThe governing law, the courts that hear disputes and the contracting entity will be set once the operating company is confirmed, and this section will be completed before launch.
Changes to these terms
#We may update these Terms. Material changes are posted here with a new date and emailed to account holders before they take effect. Using the Services after that date means you accept the updated Terms.
